Jiah Khan case: Trial court adjourn hearing till June 10

The special women’s court has adjourned the hearing in the Jiah Khan death case till June 10 following a petition filed by the deceased actress’ mother Rabiya Khan.

Special Judge A S Shende postponed the case after Rabiya appealed to the court on Friday that a petition seeking a probe by a Special Investigation Team in the case was pending before the Bombay High Court. In the petition, Rabiya had alleged that the CBI, which is presently investigating the case, had concurred with the findings of Mumbai police that Jiah’s death was suicide and not homicidal death.

Advocate Subhash Jha, appearing on behalf of Rabiya, told the trial court that they would require time for the HC to dispose and decide the pending application.

Meanwhile, a vacation bench of the Bombay High Court stayed the trial against accused Sooraj Pancholi before the special women’s court, and posted Rabiya’s petition seeking SIT probe for hearing on June 7.

The trial court is hearing arguments on charges to be framed against Jiah’s then boyfriend Sooraj who is accused of abetting her suicide. The prosecution has sought charges of murder, rape and causing miscarriage without a woman’s consent against Sooraj. The actor, too, has filed a discharge application before the court.

Jiah Khan, an American citizen of Indian origin, was found hanging in her Juhu apartment in June, 2013. Sooraj Pancholi has been charged with abetting her suicide.

Jiah was found hanging in her room on June 3, 2013. Her then boyfriend actor Sooraj Pancholi was arrested on June 10, 2013 for allegedly abetting her suicide. But he was released on July 2 after the High Court granted him bail. After a petition by Rabiya, the case was handed over to the CBI by the High Court in July 2014.

In February this year, Rabiya filed a fresh petition at the Bombay HC seeking an SIT probe pointing out anomalies in the CBI report filed in December last ye
