Anita Advani slaps domestic violence case against Akshay, Dimple

The Supreme Court issued court notice to Dimple Kapadia, her son-in-law actor Akshay Kumar and daughter Twinkle Khanna on an appeal of Anita Advani, yesteryears heartthrob Rajesh Khanna’s live-in partner. The petition filed by Anita Advani seeks reinstatement of her complaint of being subjected to domestic violence after the death of Rajesh Khanna.

The notice was issued by a three-judge bench comprising Chief Justice H L Dattu and Justices Arun Mishra and Amitava Roy after hearing brief arguments of Advani's counsel.

Advani’s counsel’s senior lawyers C A Sundaram and Jatin Zaveri, criticized the Bombay High Court order for dismissing Advani's complaint lodged against the three actors under the Protection of Women from Domestic Violence Act.

"She was not married to late Rajesh Khanna, but she was in a relationship which was of the nature of marriage," he said, adding that her complaint was wrongly dismissed. He claimed that Advani was in "live-in" relationship with Khanna.

Senior counsel C A Sundaram, told the court that his client had been living with Mr Khanna for 25 years after his actress wife Dimple Kapadia separated from him.

The Bombay high court in April dismissed the complaint lodged by Anita after she was evicted from Rajesh Khanna bungalow ‘Aashirwad’. The High Court said that Anita’s relation with Rajesh Khanna was not of the nature of marriage and she cannot seek relief under the Act. But Anita’s counsels C A Sundaram and Jatin Zaveri,  strongly criticized the Bombay High Court order for dismissing their client’s complaint filed against the actors.

Anita Advani sought monthly maintenance and a three-bedroom flat in Bandra.
