HC stays order to hand over Rajesh Khanna's will to Anita Advani
Another hearing on Twinkle Khanna’s plea against the order of Bombay High Court single judge over the will of late actor Rajesh Khanna was held on Monday. The single judge had ordered that Anita Advani who has claimed to be the live-in partner of Khanna, is to be given a copy of his last will. Against this order Rajesh Khanna’s elder daughter Twinkle Khanna had filed a petition to the division bench of the high court.
At the hearing, a division bench consisting of chief justice Mohit Shah and Justice MS Sonak heard the plea made by Twinkle and stayed the earlier order of the single judge that allowed Anita Advani to get a copy of the will. Anita had also been given access to the documents regarding the will’s probate (validation by court) procedure filed by Rajesh Khanna’s daughter Twinkle and Rinke Khanna. Janak Dwarkadas and Birendra Saraf, lawyers of Twinkle Khanna argued in court that Anita Advani was neither a family member nor an heir of Rajesh Khanna. Her claims are based on a complaint that she lodged under the domestic violence act and the domestic violence act has no provision for such a claim. On the other hand Advani's lawyer Manohar Shetty has already told the Bombay high court that his client would not be pressing to get a copy of the will and other related documents until the matter was resolved by the High Court division bench.
Monday’s decision is seen as a blow to Anita Advani. When the single judge had ruled in her favor, she had expressed her thanks to judiciary by saying, “I am extremely thankful to the judicial system. I am grateful to them. This is the third time I have won the case. I got this news yesterday (Wednesday) and I am extremely happy. Let me get the will, then I will think what to do next.” At that time she had also announced that soon she will be challenging in court, the sale of Rajesh Khanna’s bungalow by his family. She had said, “I have also challenged the sale of the bungalow. I want to convert it into a museum. It’s my and Kakaji’s dream so let’s see. Rs.90 crore is just peanuts for that bungalow. It’s worth much more. It’s prime property.” While Rajesh Khanna in his will have named his daughters as heirs, Anita has claimed that it is forged to deprive her from her share.
